Anbernic, a Chinese manufacturer of handheld consoles designed for retro game emulation, has been recommended by the Entertainment Software Association (ESA) for inclusion on a U.S. list of markets considered problematic because of intellectual property violations. The recommendation primarily targets devices sold with microSD cards loaded with pirated games.

The recommendation was submitted to the Office of the United States Trade Representative (USTR), which is responsible for reviewing the document and deciding whether to accept the classification. According to the ESA, Anbernic sells consoles bundled with cards containing hundreds or thousands of unauthorized copies of copyrighted games. These files allow users to play the titles without a legitimate purchase or license.

The association classified the company as a superfake, a term used for high-quality counterfeit products that closely imitate genuine items. In this case, the comparison refers to the way the devices are marketed with unauthorized game libraries, not necessarily to the consoles' hardware.

The document also cites a seizure carried out in Italy in 2024. At the time, authorities found approximately 12 thousand devices from the brand containing more than 47 million pirated game copies. The ESA also says that Anbernic has been operating for about nine years and typically releases between eight and ten models per year. In August 2026, the manufacturer's official website reportedly received about 1.4 million visits.

Potential inclusion on the list does not mean that all Anbernic consoles will automatically be banned in the United States. It has not yet been determined whether any action would affect only products with cards containing pirated games or other devices as well. The consequences could involve distributors, inventory and marketplaces such as Amazon and eBay, as well as future releases like the Anbernic RG DDS.

The ESA's complaint distinguishes between selling a device capable of emulating older games and distributing unauthorized copies. Until the U.S. government makes a decision, there is no confirmation that the products will be removed from the market.
