President Luiz Inácio Lula da Silva signed the Desenvolve Gamers Brasil decree on Wednesday (14), setting out rules for implementing the Marco Legal da Indústria de Jogos Eletrônicos. Signed into law in May 2024, the legislation now has guidelines for bringing the gaming industry into public policies on culture, education, health and accessibility.Culture Minister Margareth Menezes said the rules cement the recognition of games as cultural products and interactive audiovisual works. In practice, that gives the industry access to existing funding programs. The Ministry of Culture (MinC) drafted the decree in consultation with other ministries and organizations including Abragames. One measure creates Game Brasil, a free public platform that will catalogue Brazilian games and developers and show where titles are available. The planned initial investment is R$ 1.4 million. MinC will also be able to maintain a repository of games funded with public money for use by public education, research and health institutions, subject to copyright protections. The funding package includes a proposed R$ 200 million call for applications from Finep for technology companies developing games and digital solutions. The government also proposes lowering the minimum loan from the Audiovisual Sector Fund from R$ 500,000 to R$ 150,000 and cutting annual interest from TR plus 2% to TR plus 0.5%. For 2026, the fund expects to make R$ 460 million in credit available to the audiovisual sector, including games. The Ministry of Education will create undergraduate game development courses at five federal universities, one in each region, with 230 places agreed. For 2027, MinC is planning two initiatives expected to raise R$ 50 million each: one for game development labs and spaces, and another for the production, release and marketing of Brazilian independent games. The decree also provides for simplified procedures to register games with the INPI and measures to protect intellectual property. Rules concerning children and adolescents must follow the ECA Digital, while the Ministry of Health will set standards for games intended for therapeutic use.
